Terms and Conditions

These terms and condition (the “Terms and Conditions”) govern the use of andrewlittle.nz (the “Site”) and are current as at 1 November 2025.

The site is owned and operated by the Andrew Little for Mayor campaign (“The Campaign”). For the avoidance of doubt, the Site is not owned or operated by Wellington City Council or the New Zealand Labour Party.

By using this Site, you indicate that you have read the understood these Terms and Conditions and agree to abide by them at all times.

THESE TERMS AND CONDITIONS CONTAIN A DISPUTE RESOLUTION CLAUSE THAT IMPACTS YOUR RIGHTS ABOUT HOW TO RESOLVE DISPUTES. PLEASE READ IT CAREFULLY.

Intellectual Property

All content published and made available on this Site is the property of The Campaign and the Site’s creators, or is used under licence or with permission. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of the Site.

News and biographical content is provided under a Creative Commons Attribution-NoDerivatives 4.0 International licence.

Donations

The Campaign will treat all donations received in accordance with the provisions of the Local Electoral Act 2001.

The Campaign is required by law to keep records of all donors and contributions. Individual or aggregate contribution of NZD $1,500 or more (including any GST) of money, goods or services, may be publicly disclosed before the next election day and must also be must be publicly disclosed in a return to the Wellington City Council that will be published on the Council’s public website.

If you chose to make a contribution you must provide The Campaign with: your name, your address, the total amount of your contribution or, in the case of aggregated contributions, the total amount of the aggregated contributions.

The Campaign cannot accept donations exceeding NZD $50 (including any GST) from individuals who reside outside New Zealand and are neither a New Zealand citizen nor a registered elector.

Any contribution you make will not be tax deductible in New Zealand.

If The Campaign were to receive an anonymous individual or aggregate contribution exceeding NZD $1,500 (including any GST) The Campaign must surrender the amount over that limit to the electoral officer and cannot issue a refund.

If you have opted to make ongoing donations by subscription, your subscription will automatically renew and you will be automatically billed until we receive notification that you want to cancel the subscription. To cancel your subscription email info@andrewlittle.nz.

Any other refunds will be made at the discretion of The Campaign.

Sale of Goods and Event Tickets

From time to time The Campaign may sell Goods and Event Tickets on the Site.

These Terms and Conditions govern the sale of goods available on the Site.

The following Goods and Event Tickets may be available on the Site from time to time:

  • Campaign Merchandise

  • Fundraising event tickets

  • Special promotions

All information, descriptions, or images that The Campaign provides are as accurate as possible at the time of publication.

We reserve the right to modify, reject or cancel your order whenever it becomes necessary. If we cancel your order and have already processed your payment, we will give you a refund equal to the amount you paid. You agree that it is your responsibility to verify receipt of any refund.

Payments

The Campaign uses a third party payments provider, Squarespace Payments, to receive payments through the Site by debit card, credit card, Apple Pay and Google Pay. Only the third party payments provider keeps a record of your payment instrument information.

When you provide your payment information through the Site, you authorise our use of and access to the payment instrument you have chosen to use. By providing your payment information through the Site, you authorise our third payment payments provider to change the amount due to this payment instrument.

If you believe your payment has violated any law or these Terms and Conditions, we reserve the right to cancel or reverse your transaction.

All transaction amounts are in New Zealand Dollars (NZD).

We do not allow Buy Now Pay Later (BNPL) services on the Site.

Shipping and Delivery

When you purchase Goods from the Site, the goods will be delivered by post or courier to an address within New Zealand.

Delivery will take place as soon as reasonably possible, depending on the delivery method selected or available. Delivery times may vary due to unforeseen circumstances. Please note that delivery times do not include weekends and statutory holidays.

If there is a charge for the delivery of the Goods you purchase on the Site this will be clearly indicated. By completing your purchase you agree to this charge.

You are required to provide The Campaign with a complete and accurate delivery address, including the name of the recipient. The Campaign are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Consumer protection law

Where the Consumer Guarantees Act 1993, the Contract and Commercial Law Act 2017, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

Limitation of Liability

The Campaign, Andrew Little, officers, employees and affiliates will not liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

Indemnity

Except where provided by law, by using this Site you indemnify and hold harmless The Campaign, Andrew Little, officers, employees and affiliates rom any actions, claims, losses, damages, liabilities and expenses, including legal fees arising out of use of the Site or your violation of these Terms and Conditions.

Applicable Law

These Terms and Conditions are governed by the laws of New Zealand

Dispute Resolution

Subject to any exceptions specified in these Terms and Conditions, in you and The Campaign are unable to resolve any dispute through informal discussions, then you and The Campaign agree to submit the issue first before a non-binding mediator and to an arbitrator in the event that mediation fails. The decision of the arbitrator will be final and binding. Any mediator or arbitrator must be a neutral party acceptable to both you and The Campaign. The costs of any mediation or arbitration will be paid by the unsuccessful party.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes in the way the Site and the way The Campaign expects users to behave on the Site.

This website collects publicly available information about your computer and network so we can optimise our website.

If you use certain features on this website we may collect personal information to provide personalised content to you, respond to requests you make through contact forms, and to accept donations and sell event tickets and merchandise. The information we may request includes your:

Besides our staff, we share this information with:

  • providers of the services and components that allow us to serve the website to you, such as our website content management system provider

  • analytics providers, at times specifically Google Analytics and Meta Pixel

  • legal authorities where required by law, for example the Wellington City Council electoral returning officer

  • Wellington City Council officers where you have submitted a query that is best managed by Council officers
